As you saw, under Florida law you can recover your medical bills in connection with your bicycle accident. Further, you can also recover your future medical bills for treatment you have not yet received but are reasonably certain to incur in the future.

Importantly, to recover damages for your future medical care and expenses you must have a doctor testify that you are reasonably certain to incur the treatment and expenses in the future. As explained in White v. Westlund, 624 So. 2d 1148 (Fla. 4th DCA 1993), you cannot recover your future medical expenses if your doctor says you “may” or there is a “possibility” you will incur future medical expenses. This will not cut it. Again, your doctor must testify that you are reasonably certain to incur the future medical care and expenses.
