Why Won’t A Lawyer Take On My Personal Injury Case?
You were involved in an accident and got hurt. And you have good reason to believe another party was at fault for causing the accident. Yet, you can’t find a lawyer to take your case. In fact, you’ve called several law firms and all have declined to represent you. Why is this? Why won’t a lawyer take on my personal injury case?
There are several possible reasons why you can’t find legal representation.
I will discuss some of them here.
First: Your Case Is Too Small
Many lawyers will not handle a case if it is too small. Put another way, if they do not think you suffered serious injuries, they don’t think it’s worth their time.
This is unfortunate but true.
Of course, not every injury case involves catastrophic, life-changing injuries. But even if your injuries are minor, you still deserve legal representation.
Second: Your Case Is Out Of The Lawyer’s Area Of Expertise
Even within personal injury law, there area a number of different areas and practices which require specialized experience and care.
For example, many personal injury lawyers do not handle medical malpractice cases. And, conversely, some personal injury lawyers only handle medical malpractice cases.
So just because a lawyer is a personal injury lawyer, it does not mean he or she handles all personal injury claims.
Third: There Is No One At Fault For Your Injuries
Just because you were involved in an accident does not mean you have a valid personal injury claim or that someone was responsible for your injuries.
Someone or some entity must have been negligent. Without negligence you don’t have a case.
Fourth: You Waited Too Long
Personal injury claims, like any other legal claim, have statute of limitations. If you are past the statute of limitations, it may be too late to file and pursue your claim.
Fifth: The Negligent Party Does Not Have Insurance Or Assets To Pay Your Claim
While you may have been the victim of another person’s negligence, you still need a potential source of financial recovery.
For example, many drivers in Florida do not have car insurance. In fact, in an excellent report by ValuePenguin, ValuePenguin found that Florida has the highest estimated percentage of uninsured drivers in the United States at 26.7%! This is shocking statistic.
So even though you may have been injured by another person’s negligence, if a negligent driver does not have bodily injury insurance (and you don’t have uninsured motorist coverage), there’s little chance for any type of financial recovery for you and your attorney.
No Lawyer Will Take My Case – Should I Just Give Up?
No, you should not!
Just because a lawyer declined to represent you, does not mean you should give up. Lawyers can often see the same case or fact pattern differently, or simply have a difference of opinion.
Let me give you a personal example.
Recently, a client approached me to handle her personal injury case. She was honest with me; several lawyers declined to take her case.
I believed her case had merit and decided to represent her.
After several months, I was able to successfully settle her case. The client was quite happy with the result, especially considering she could not find a lawyer to help her.
So while other lawyers saw no case, I believed the case had merit. Thankfully, it turned out I was right.
So even if you have been told you don’t have a valid personal injury case, don’t give up. Another lawyer may see things differently.
